are the operator (hereinafter referred to as "we" or "operator") of the application PUMPMOVE Performance (hereinafter referred to as " application") and the services offered on it and therefore responsible for the collection, processing and use of personal data within the meaning of the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG).

The principle of data economy is already of great importance to us when collecting data. We collect and process personal data only insofar as you have given us your consent to do so or the legislator expressly permits us to do so or requires us to do so or you allow us to do so. In the following, we explain to you which data we collect, how we use this data and which rights you have with regard to the use of your data:

2. COLLECTION AND STORAGE OF PERSONAL DATA

2.1. PERSONAL DATA

The term personal data is defined in the Federal Data Protection Act. According to this, this is individual information about personal or factual circumstances of a specific or identifiable natural person. This includes, for example, your civil name, address, telephone number or date of birth. Furthermore, it also includes company-related data.

2.2. COLLECTION

a) When using our application

Unless otherwise stated in the following sections, no personal data is collected, processed or used when using our application.

When using our application, our servers save each access in a log file. The following data is collected without your intervention and stored by us on a server outside the European Union:

the IP address assigned to your computer,

the name and URL of the requested file,

Referrer URL (the previously visited page),

Date and time of the request,

Operating system, smartphone manufacturer, operating system version, internet provider, application version, gender, weight, location data, line data (mastered training weight, number of repetitions of exercises, distance of training, time data of training) of the person.

If you contact us by e-mail, we will store your e-mail address and the other information. This is done solely for the purpose of replying to you or, if necessary, to contact you again at a later date regarding the subject of your inquiry.

b) when registering for free on our application as a user (hereinafter "registered user").

Provided you are at least 18 years old, you can register for free on our application to create a user account and use our related services. As part of the registration process, we require

Created user accounts are valid within the PUMPMOVE application.

2.3. STORAGE

We store and process your personal data on our own servers in a member state of the European Union. We protect your data by technical and organizational security measures to minimize risks related to loss, misuse, unauthorized access and unauthorized disclosure and modification of this data. For example, firewalls and data encryption are used for this purpose, as well as physical access restrictions and authorization controls for data access. We take steps to ensure that the personal data we collect is accurate and up-to-date.

You may informally withdraw your consent to the use or disclosure of your personal data at any time. If you revoke your consent to the use or transfer of your personal information for the purposes set forth in this Privacy Policy, we may no longer be able to provide you with access to our application, apps or tools or to provide the services and customer support offered to our users and authorized under this Privacy Policy and our Terms of Use.

You may informally withdraw your consent to the use or disclosure of your personal data at any time. If you withdraw your consent to the use or transfer of your personal data for the purposes stated in this Privacy Policy, we may no longer be able to provide you with access to our application, apps or tools or to provide the services and customer services offered to our users and authorized under this Privacy Policy and our Terms of Use.

3. USE OF PERSONAL DATA

The collection and processing of your personal data is carried out to manage the mutual contractual relationship, in particular for the purpose of:

To have knowledge of who our contractual partner is;

to check the entered data for plausibility and business capability of the users,

to establish a contractual relationship with you regarding the use of the application and the services offered on it, to design the content of the contract, to process it and, if necessary, to change it,

to be able to contact you in the event of queries.

Before the aforementioned data is evaluated, it is pseudonymized. This allows us to evaluate user behavior without a specific personal reference in order to improve our application and services. You can object to the use of your personal data for advertising purposes at any time, either as a whole or for individual measures. An informal message in text form to the contact details listed below (e.g. e-mail, fax, letter) is sufficient for this purpose.

4. DISCLOSURE OF DATA

4.1. TRANSFER OF PERSONAL DATA TO THIRD PARTIES

Your personal data will only be disclosed or otherwise transferred to third parties if this is necessary for the purpose of processing the contract or if you have given your prior consent. We will not sell or otherwise transfer your data to third parties without your consent. Something else only applies if there is a legal obligation to do so (e.g. information to certain authorities within the scope of their legal duties) or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship with you.

 

4.2. INTEGRATION OF SERVICES AND CONTENTS OF THIRD PARTIES

It is possible that third-party content, such as videos from YouTube, map material from Google Maps, RSS feeds or graphics from other websites are integrated on our application. This always requires that the providers of this content ("third-party providers") perceive the IP address of the user. This is because without the IP address they would not be able to send the content to the browser of the respective user. The IP address is thus necessary for the display of this content. We endeavor to use only such content whose respective providers use the IP address only for the delivery of the content. However, we have no influence if the third-party providers store the IP address, e.g. for statistical purposes. Insofar as this is known to us, we inform the users about it.

4.5. COOKIES AND WEB ANALYSIS SERVICES

For statistical analysis purposes, we use Google Analytics and Google Firebase Analytics on our application, two web analytics services provided by Google Inc. ("Google"). Google Analytics and Google Firebase Analytics use their own cookies. This involves storing text files on your computer that enable an analysis of your use of the application. The information generated by the cookie about your use of our application is usually transmitted to a Google server in the USA and stored there.

To prevent the personalization of this data, your IP address is anonymized by shortening it. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and only anonymized there. Google will use the information on our behalf for the purpose of evaluating your use of the website, compiling reports on app activity and providing other services relating to app usage and internet usage to us.

Google is obliged not to merge the IP address transmitted by your browser as part of Google Analytics with other data. You can also prevent the storage of cookies by selecting the appropriate settings on your browser software. However, we would like to point out that in this case you may not be able to use all functions of our application to their full extent. In addition, you can generally prevent the collection of data generated by the cookie and related to your use of the application (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

4.6. SOCIAL PLUG-INS

​

1. we use social plug-ins of the facebook.com network, namely the "Like" button and the "Share" button. These plug-ins are offered by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA and transmit data to Facebook. They are marked with the Facebook "f". By activating these plug-ins, your browser establishes a connection to Facebook's servers. The content of the plug-in is transmitted directly to your browser. The plug-in is part of Facebook and is merely displayed on our application. Any interaction via the plug-in is an interaction on "facebook.com" and not on our application. We have no influence on the content of the plug-in. At the same time, Facebook sets one or more cookies in your browser.

Through the active plug-in and the cookie or cookies, Facebook receives data, even if you have not yet clicked on the plug-in itself and even if you do not have a Facebook account. According to Facebook, this data includes the application used, the date, the time, browser type and version, operating system and version, and to our knowledge also IP address and Facebook cookies already stored in the browser. Facebook can thus track which other applications and websites with Facebook content (this includes these plug-ins) they were on. Facebook uses this data to find errors in its own system, to improve its own products and adapt them to user behavior, to control, place and individualize advertising, for localization, to record the way in which applications and websites with Facebook content are used and for the purpose of market research.

If you are logged in to Facebook when you activate the plug-ins, your Facebook login identification number is also transmitted to Facebook. This allows your visit to our application to be directly associated with your Facebook account. You will then be identified by Facebook with your Facebook name and your private data from the Facebook account. In the case of interaction with the Facebook plug-in, i.e. when you click on it, this information is not only transmitted to the Facebook servers, but depending on the settings of your Facebook account, it is also published on Facebook and displayed to your friends. If you want to avoid this, you must first log out of your Facebook account before activating the Facebook plug-ins and delete all Facebook cookies after visiting applications and websites with Facebook plug-ins. According to its own information, Facebook stores all this data for up to 90 days. After that, Facebook anonymizes this data and only uses it in anonymized and aggregated form, for example to improve advertising.

Facebook's plug-ins are set in such a way that we do not receive any of the information that is transmitted with the plug-in or the Facebook cookies. We can only determine that you have clicked on the plug-in at all and shared our content with others.

2. we use the Google+ plug-in ("+1" on white background) of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. When you visit a page that contains such a plug-in, your browser establishes a direct connection with Google's servers. As a result, information about your use of the application is forwarded to Google. We have no influence on the content of the plug-in. If you are logged into a user account on Google+ or Google during your visit, Google can assign the use of the application to this account. By interacting with plug-ins, this corresponding information is transmitted directly to Google and stored there. If you wish to prevent such data transmission, you must log out of your Google Plus or Google account before visiting our website.

We have no influence on the scope and content of the data that Google collects with the button. You can inform yourself about the purpose, scope of data collection by Google. If you do not want Google to collect data about you when you call up our application and link it to your membership data stored with Google, you must log out of Google before using our application.

3. plug-ins of the social network Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA are also integrated on this application. You can recognize the Instagram plug-in by the "Instagram button" on our page. If you click the "Instagram button" while you are logged into your Instagram account, you can link the content of our pages on your Instagram profile. This allows Instagram to associate the visit to our pages with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram.
